2. Scope

These Terms apply to all orders placed on our website and to the use of the website. If you do not agree, do not place an order.

If you order as a consumer (a private individual acting outside your business), you have mandatory rights under EU and Hungarian consumer law. Nothing in these Terms limits those mandatory rights.

3. Where we sell and deliver

We currently sell and deliver to the following regions:

• Hungary
• Croatia
• BeNeLux (Belgium, the Netherlands, Luxembourg)

If a specific delivery method or destination is unavailable, it will not be offered at checkout.

4. Product information

We do our best to keep product descriptions, photos, availability and prices accurate. Obvious mistakes do not bind us.

For natural products (seeds, bulbs, tubers, live plants), results depend on conditions outside our control (weather, soil, storage, planting and care). We do not guarantee specific growth, yield, or performance outcomes.

5. How the contract is formed

Placing items in the cart is not an offer. Your order is an offer to buy.

A contract is formed when we confirm acceptance by email (order acceptance and or dispatch confirmation). If you do not receive confirmation within 48 hours, you are released from your offer and any obligation connected to it.

We may refuse or cancel an order, for example if payment fails, stock is unavailable, delivery is not possible, fraud is suspected, or a clear error occurred.

6. Prices, VAT, and payment

Prices are shown in the currency displayed on the website and include VAT unless stated otherwise. Shipping costs are shown at checkout.

We accept the payment methods shown at checkout.

Cash on Delivery (if offered)
By choosing Cash on Delivery, you agree to pay the full amount upon delivery. If you refuse delivery without a lawful reason, you may be responsible for the direct costs we incur for shipping and return transport, to the extent permitted by law.

7. Delivery

Estimated delivery times shown on the website are indicative and not a guaranteed deadline. Delays may occur due to carrier capacity, weather, peak periods, or other events outside our control.

We may deliver in parts. If we do, you only pay for what is delivered, unless your chosen payment method requires full payment upfront.

Risk of loss or damage passes to you when you (or a person you appoint) receive the parcel. Please inspect the parcel on delivery. If the parcel is visibly damaged, record this with the carrier where possible and contact us as soon as possible with photos.

8. Right of withdrawal for consumers

If you are a consumer, you can withdraw from the purchase within 14 calendar days without giving a reason.

The withdrawal period starts on the day you (or your nominee) receive the goods.

To exercise withdrawal, email us within the 14 days at kapcsolat@hollandkerteszet.hu with a clear statement that you withdraw from the contract and include your order number.

9. Effects of withdrawal, returns, and refunds

Refund timing
We refund payments received for the returned goods within 14 days from the day we are informed of your withdrawal. We may withhold the refund until we receive the goods back or you provide proof of return shipment, whichever is earlier.

What we refund
We refund the price paid for the returned goods. Where required by consumer law, we also refund the standard outbound shipping cost for the withdrawn items. If you chose a more expensive delivery option than the standard option offered, we do not refund the extra cost.

Return shipping cost
Unless we confirm otherwise in writing, the direct cost of returning goods is paid by you.

Condition of returned goods
You may handle the goods only as needed to check their nature and characteristics. You are responsible for any reduction in value caused by handling beyond what is necessary.

10. Withdrawal exclusions and non-returnable items

The right of withdrawal does not apply where the law excludes it. This can include, for example, goods that spoil quickly or have a short shelf life, certain live plants or planting material depending on their nature, sealed goods that were opened and cannot be returned for health or hygiene reasons, and custom made goods.

Where a specific product category is excluded due to its nature, we will indicate this on the product page or at checkout.

11. Problems, defects, incorrect items, transit damage

If your order arrives damaged, defective, or incorrect, contact us as soon as possible and include your order number and clear photos. We will propose a solution in line with applicable law, which may include replacement, price reduction, or refund.

Your statutory warranty and consumer rights apply regardless of any additional policies.

12. Complaints and customer service

You can submit complaints by email to kapcsolat@hollandkerteszet.hu. We respond in writing within 30 days of receiving your complaint, unless a different mandatory deadline applies.

13. Liability

We are liable for damages according to applicable law.

We do not exclude liability where exclusion is not permitted, including liability for intent, gross negligence, or mandatory consumer claims. To the maximum extent permitted by law, we are not liable for indirect or consequential losses. Our total liability for any claim related to an order is limited to the amount you paid for that order.

14. Intellectual property and website use

All website content (texts, images, design, logos) is owned by us or our licensors. You may not copy, reuse, publish, distribute, or exploit it without our prior written permission.

You may not misuse the website, attempt to disrupt it, or access it unlawfully.

15. Privacy

We process personal data as described in our Privacy Policy.

16. Governing law and disputes

These Terms are governed by Hungarian law.

If you are a consumer, mandatory consumer protection rules may allow you to bring claims in your country of residence within the EU. Otherwise, disputes fall under the jurisdiction of the Hungarian courts.

17. Changes to these Terms

We may update these Terms. The version published on the website applies to orders placed after the effective date shown at the top.

18. Severability

If any clause is invalid, the rest remains in force. The invalid clause will be replaced by a valid clause that best matches the original intent.
